GUEST RENTAL LICENSE AGREEMENT (v08.00.00)

This Guest Rental License Agreement (“Agreement”) is made by and between Mars Hill Getaways (“Owner”) and the renter (“Guest”) as of the date last written on the signature page of this Agreement.  Owner and Guest may be referred to individually as “Party” and collectively as “Parties.”  For good and valuable consideration, the sufficiency of which is acknowledged, the Parties agree as follows:

  1. Property. Guest is responsible for purchasing additional supplies after initial starter items runs out.  Guest is responsible for bringing or purchasing any additional supplies and all food and beverages (including salt, pepper, and cooking spices).  Guest agrees to exercise care in the treatment of the accommodations and furnishings and to leave the house the same way or better than how they received it during check-in. The Property is fully furnished and comes equipped with the following amenities. 
    • Normal housekeeping cookware, utensils, dishware, and glassware
    • Pillows, comforters, and linens are provided for each bed.
    • Kitchen towels, bath towels; hand towels for each bathroom; bath floor mats
    • Starter items:
      • Toilet paper
      • Paper towel
      • Kitchen trash bags
      • Dishwasher detergent
      • Laundry detergent
      • Fabric softener sheets
      • Dish sponge
    • Hand soap, dish soap, and basic cleaning supplies (all purpose cleaner, mop, broom, and vacuum)
    • Complimentary Wifi
    • Complimentary onsite parking – Please park only on the driveway.  Unregistered vehicles or vehicles found parked/driving over lawn will be assessed a fine of $50/vehicle/occurrence. 
  1. Rental PartyGuest agrees and certifies that they are 25 years or older and agrees to provide a copy of a valid Driver’s License in conjunction with signing this Agreement.

All persons in the rental party will be bound by the terms of this Agreement.  Only persons listed on this Agreement may stay at the Property.  In certain counties guests will be required to disclose first and last names of all adults above the age of 18 to comply with rental regulations at the request of the Host.

  1. Maximum Occupancy.  The maximum occupancy for the Property is limited to 16 people(not including infants 2 years or younger) at any time, unless prior approval has been given for more.  Once approval has been granted for groups larger than 16 persons, there will be an additional $50 per person per night charge for each person who stays at the Property above the maximum occupancy limit.
  1. No Rights of Tenancy.  Guest acknowledges and understands that he/she is a temporary guest of the Property and not a tenant.  Nothing herein confers any rights of tenancy upon Guest.
  1. Rental Period & Check-in.  The term of the rental period shall begin and shall end on the dates specified on the source of booking platform.  The Property will be ready for Guest’s occupancy at 4:00 P.M., on the Arrival Date, and the Property must be vacated by 10:00 A.M., on the Departure Date unless otherwise authorized.  If Guest would like an extension on these times, please contact the property host 24 hours before your arrival/departure.  Extensions are not guaranteed. Hosts will need to check with housekeeping and see if the Guest request can be granted. Authorized extensions will incur an additional charge of $50 per hour.  If the guest remains on the property past their authorized checkout time, the guest agrees to pay a $200 late checkout penalty fine.
  1. HOA and County Rental Rules.  Guest agrees to abide by all residing County and HOA regulations at all times while at the Property and shall cause all members of the Rental Party to do the same.  Failure to abide by these Rental Rules shall result in the Rental Party being asked to vacate the Property and the forfeiture of any rental payments, fees, and/or deposits. 
  1. Property Care.  Arrival and departure inspections are done on the property before and after each Guest stay.  Guest is responsible for immediately reporting to the property host via photography if he/she notices any damages and/or missing items.  Failure to report may result in charges if these items are missing or damaged upon checkout.  Guest agrees to surrender Property in the same condition as of the commencement of the rental period, with reasonable wear and tear expected. Guest agrees to reimburse Owner the amount of all damages/extra charges, lost rentals, and county fines associated with Guest’s stay, including reasonable attorney fees. Guest will be responsible for any cost of repair or replacement required as a result of damage caused by the Rental Party during the rental term. The following list contains examples of items that the guest will be charged extra for (not an exhaustive list):
    • Stains on furniture, carpets, linens, towels, bedding.
    • Any damages found upon check out that the guest did not report via photography during the check-in process.
    • Missing items found during checkout inspection (e.g. missing remotes, etc).
    • Movement of furniture from its original location.
    • Burnt on food or damage to cookware.
    • Loose trash or leaky bags resulting in extra dirty trash carts.  Not complying with the trash rules.
    • Leaving the house excessively dirty resulting in additional cleaning hours.
    • Dirty dishes found during checkout inspection.

Owner shall have the right to inspect and make repairs to the property, its fixtures, appliances, furnishings, and facilities during the rental period.

  1. Rental Rate, deposit, and Fees. As listed in the Airbnb/VRBO reservation system or separate agreement and subject to change. Refer to the official reservation for details.  The home will be checked upon Guest departure and if a security deposit was charged to the Guest, the security deposit will be refunded within 15 days from guest’s Departure Date less any itemized damages, citations, or extra charges.
  1. Cancellations/Refunds –  Refer to the official reservation for details.  Please review the cancellation policy on Airbnb/VRBO or the direct booking website.
  1. Property Access – Gate and Main entrance access codes will be provided at least 24 hours before the Arrival Date. If for any reason Guest is denied access to the subject property, Owner Liability shall be limited to the return of all monies paid on account.
  1. Firepit – Guest agrees to comply with the following house, HOA, and County ordinance regarding outdoor fires:
    • Burning is only permitted in the firepit provided
    • Permitted burning materials include dry clean logs, twigs, or other untreated wood products
    • Prohibited burning materials include, but not limited to, treated wood, fresh cut limbs, leaves, manufactured products, garbage or other material that may cause excessive odor or smoke
    • Adult supervision is required at all times until fire has been completely extinguished.
    • If winds exceed 10 miles per hour, burning is not permitted.
    • No fires are allowed during quiet hours between 10pm – 8am. 
  1. Malfunctions – Guest shall not be entitled to any refund for inoperable appliances, hot tubs, arcade system, tvs, electronic items, etc. Owner, upon being notified by Guest, of any malfunction, will make every reasonable effort to have such items replaced or repaired but this cannot be guaranteed.
  1. Pets – UNAUTHORIZED PETS are prohibited and are grounds for immediate termination of contract resulting in immediate eviction and loss of security deposit or $500, whichever is greater.   Guest could be liable for professional carpet cleaning, duct cleaning, and additional damages if an unauthorized pet is found on the property.  Guests must adhere to the following pet policy if owner agrees to allow said pet(s) on the property:

Only dogs are allowed and no more than 2 are allowed per stay unless otherwise authorized.

  1. A pet fee of $250 for the first two dog and $50 for all subsequent dogs will be required.  This fee is for the privilege of having a pet at the property.  It does not cover damages or stains caused by the pet.
  2. Dogs must be house trained and well behaved.
  3. Dogs are not allowed on any furniture (i.e. sofas, beds, etc)
  4. Dogs are not allowed in any carpeted area.
  5. Dogs must not be left unattended in the house unless crated.
  6. Guest must pick up and appropriately dispose of dog excrement from the property and community areas.  
  1. Prohibited at Property – FIREWORKS, INDOOR SMOKING, HOUSE PARTIES AND ILLEGAL DRUG USE are prohibited and are grounds for immediate termination of contract resulting in immediate eviction and loss of security deposit or $500, whichever is greater.  This would include loud music or noise levels, drunken behavior, drug use or activity that results in neighbor complaints or police reporting.  Guests will face possible State prosecution for using fireworks on this property.  Guests could also be liable for professional carpet cleaning, duct cleaning, re-painting and additional damages. 
  1. Quiet Hours – 10pm to 8am – Refrain from loud outdoor and indoor noise between the hours of 10pm and 8am.  Please keep noise levels from music and loud talking to a reasonable level at all times. 

If we receive a neighbor or police complaint, the following will be enforced:

1st time – $50 fee

2nd time – $500 fee

  1. Surveillance Devices – Exterior house cameras are installed for the security of the Guest and owner.  We have cameras to monitor the entry, driveway backyard, and decks.
  1. Trash – ALL trash must be bagged and placed inside trash receptacles.  Recycling receptacles are also available for recyclables and are located next to the trash receptacles.
  1. Limitation on Liability.  Owner is not responsible for any accidents, injuries, or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property.  Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors.  Guest agrees to assume the risk of any harm arising from use of the Property.  UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR TO ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY.  IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. 
  1. Indemnification.  Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk.  Guest will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of, or damage to, personal property, injury or death resulting from the use or occupancy of the Property, or the failure of any member of the Rental Party or Guest’s visitors to observe the Rules and restrictions set forth in Paragraph 7.
  1. Violation of Agreement.  If Guest, Guest’s visitors, or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors, or the Rental Rules, Owner may evict Guest and the Rental Party from the Property, and Guest will forfeit all rent and deposits paid.  Should Owner elect to hire an attorney to collect any sums due under this Agreement or enforce any provision of this Agreement, Guest shall be liable for all reasonable attorney’s fees incurred by Owner.
  1. Governing Law.  This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with, the laws of the Commonwealth of Virginia (including its conflicts of laws provisions).
  1. Severability.  If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement. 
  1. Entire Agreement.  This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings, and representations (if any) made by and between the Parties.

The Parties agree to the terms of this Agreement and set their signatures below, intending to be legally bound.
